WASHINGTON – US President Donald Trump has signed two new executive orders aimed at restricting birthright citizenship in certain cases and addressing what his administration describes as “birth tourism.”
According to media reports, the new orders seek to limit automatic US citizenship for some children born in the United States to foreign parents. The move follows Trump’s earlier executive order issued in January 2025 that attempted to restrict birthright citizenship.
The US Constitution’s 14th Amendment grants citizenship rights to nearly all people born on American soil. However, the Trump administration argues that there are historically recognized exceptions to birthright citizenship.
A statement from the White House said the first executive order identifies certain categories of children of non-citizens who would not qualify for birthright citizenship under what it described as established exceptions.
The second order delegates authority to the Secretaries of State and Homeland Security and directs officials to take measures against birth tourism, a practice in which some foreign nationals travel to the United States with the aim of giving birth there so their child can obtain US citizenship.
The administration said the orders are intended to protect the “meaning and value” of American citizenship and strengthen the country’s immigration system.
Trump had previously issued a broader order on birthright citizenship in January 2025, but the US Supreme Court rejected that effort on June 30, 2026, ruling that the earlier order could not be implemented.
The newly announced measures are narrower in scope and focus on specific circumstances, including birth tourism. However, they are also expected to face legal challenges.
The Trump administration said it remains committed to tightening immigration policies, strengthening visa screening procedures and preventing what it considers misuse of the citizenship system. The administration has maintained that its actions are aimed at prioritizing the rights of American citizens and ensuring the integrity of the immigration process.
